Plan Terms Agreement for A.I.R. by Lexvor Inc.

This Plan Terms Agreement (“Agreement”) applies to your subscription to the A.I.R. by Lexvor Inc. (“A.I.R.,” “we,” “us,” or “our”) services. By subscribing to any A.I.R. plan, you agree to these terms, which supplement our Privacy Policy and Terms and Conditions.
1. Subscription Plans
A.I.R. offers subscription plans designed to provide a range of artificial intelligence resources and services. Current plans include:

Plans may include additional features, limitations, or usage caps, which will be described in the plan details at the time of subscription.
2. Subscription Billing and Payment
a. Billing Cycle

• Subscriptions are billed monthly and renew automatically at the end of each billing period unless canceled according to the terms below.

b. Payment Method

• Payment must be made via an approved payment method at the time of subscription. By providing your payment information, you authorize A.I.R. to charge your chosen payment method on a recurring basis.

c. Subscription Fees

• Fees are set at the time of subscription and are subject to change. A.I.R. will provide prior notice of any fee changes. By continuing your subscription after the effective date of a fee change, you agree to the new fees.

d. Compliance and Activation Fees

• For some plans, a one-time activation or compliance fee may apply. These fees, if applicable, will be disclosed at the time of subscription.

3. Usage and Limitations
Each A.I.R. plan includes a specified number of AI requests per month. Requests are defined as individual interactions with the A.I.R. platform, including but not limited to text commands, image uploads, or task requests.
a. Monthly Request Limits

• Basic Plan: 150 requests per month.

• Premium Plan: 1000 requests per month.

• Unused requests do not roll over to the next billing period.

b. Excess Usage

• Exceeding your monthly request limit may result in additional charges, a temporary halt on further requests, or an automatic upgrade to a higher plan tier. Additional usage charges will be communicated before they are applied.

c. Fair Usage Policy

• A.I.R. services are intended for fair use. Excessive or unreasonable usage that impacts other users or system performance may result in temporary suspension, additional fees, or termination.

4. Refund and Cancellation Policy
a. Refunds

• All payments made to A.I.R. are non-refundable. Partial refunds will not be provided for cancellations made mid-cycle. Refunds may be provided only in instances where legally required or at our sole discretion.

b. Cancellation by User

• You may cancel your subscription at any time through your account settings or by contacting customer support. Cancellations will take effect at the end of the current billing period.

c. Cancellation by A.I.R.

• A.I.R. reserves the right to cancel or suspend your subscription if you violate these terms, exceed usage limits, or engage in prohibited activities as outlined in the Terms and Conditions.

5. Plan Changes and Upgrades
a. Upgrading Plans

• You may upgrade to a higher plan tier at any time. When you upgrade, any remaining balance for the current billing cycle will be applied toward the new plan. Your new plan and billing cycle will begin immediately upon upgrade.

b. Downgrading Plans

• You may downgrade your plan at the end of the current billing period. Downgrading is subject to usage limits, and unused requests from the previous plan will not carry over.

c. Plan Adjustments by A.I.R.

• A.I.R. reserves the right to adjust plan features, request limits, and pricing. In such cases, we will notify you in advance, and you may opt to continue or cancel your subscription.

6. Account Suspension and Termination
a. Suspension for Non-Payment

• If payment is not received on the due date, A.I.R. reserves the right to suspend your account. Service will be restored once payment is received, though A.I.R. cannot guarantee the preservation of any data or usage history during suspension.

b. Termination for Violation

• We may terminate your subscription if you violate this Agreement, the Terms and Conditions, or the Privacy Policy. Termination will take effect immediately, and you will not be eligible for any refund.

7. Data Usage and Privacy
By subscribing to an A.I.R. plan, you consent to the collection, use, and processing of your personal data as outlined in our Privacy Policy. A.I.R. is committed to safeguarding your data and will only use it in accordance with the policy.
8. Intellectual Property
A.I.R. retains ownership of all content, features, and software used to provide the services. This Agreement does not grant you any rights to use A.I.R.’s intellectual property beyond what is necessary to access and utilize the platform for its intended purposes.
9. Limitation of Liability
To the maximum extent permitted by law, A.I.R. by Lexvor Inc. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability will not exceed the subscription fees paid by you in the previous six months.
10. Modifications to the Agreement
A.I.R. may modify this Agreement from time to time. If significant changes are made, we will notify you by email or through your account. Continued use of your subscription after the effective date of any changes constitutes your acceptance of the modified terms.
11. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the State of Wyoming, without regard to its conflict of law principles. Any disputes arising from or related to this Agreement will be resolved exclusively in the courts located in Cheyenne, Wyoming.
